Terms of Service

⚠️ GlucoTV is for informational purposes only and is not intended for use in medical treatment decisions. Always confirm glucose readings with an approved medical device and consult your healthcare provider before making any treatment decisions. Do not rely on GlucoTV as a substitute for your CGM device or medical care.

1. Acceptance of Terms

By creating an account, subscribing to GlucoTV, or using any part of the GlucoTV service at glucotv.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and GlucoTV ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

GlucoTV is a software service that retrieves glucose data from compatible continuous glucose monitoring (CGM) systems and displays it on Roku TV devices and desktop browsers. The Service is designed for informational display purposes only.

GlucoTV supports the following CGM data sources:

  • Dexcom Share (via the Dexcom Share API)
  • Nightscout (via user-provided Nightscout instances)

GlucoTV is not affiliated with, endorsed by, or a product of Dexcom, Inc., Nightscout, or any other CGM manufacturer.

3. Medical Disclaimer

GlucoTV is not a medical device. It is not approved or cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory body for medical use. GlucoTV is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Glucose readings displayed by GlucoTV are retrieved from third-party CGM systems and may be delayed, inaccurate, or unavailable due to connectivity issues, CGM sensor errors, or service interruptions. You should never make medical treatment decisions based solely on readings displayed by GlucoTV.

Always confirm glucose readings with your approved CGM device or a blood glucose meter before taking any action. Always consult a qualified healthcare provider for medical advice.

4. Eligibility

You must be at least 18 years of age to create a GlucoTV account and subscribe to the Service. If you are creating an account on behalf of a minor, you represent that you are the minor's parent or legal guardian and that you accept these Terms on behalf of both yourself and the minor.

By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement.

5. Accounts

To access most features of GlucoTV you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep that information up to date. You agree not to share your account credentials with others or allow others to access your account.

You may delete your account at any time from the account settings page. Upon deletion, your account data and paired sessions will be removed in accordance with our Privacy Policy.

6. Subscriptions and Billing

Access to GlucoTV requires an active paid subscription after the free trial period ends. Subscriptions are available on a monthly ($2.00/month) or annual ($18.00/year) basis, plus applicable taxes.

A 7-day free trial is available to new subscribers. A valid payment method is required to start the free trial. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time through the account settings page or through the Stripe billing portal. Cancellation takes effect at the end of the current billing period and you will retain access through that date.

All payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service. GlucoTV does not store your payment card details.

7. Refund Policy

All subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access to the Service through the end of your current billing period. No partial refunds are provided for unused time within a billing period.

If you believe you have been charged in error, please contact us at support@glucotv.com within 30 days of the charge and we will review your situation.

8. Free Trial and Referral Codes

Each email address is eligible for one free trial. Creating multiple accounts to obtain additional free trials is not permitted.

Referral codes and promotional codes may be offered from time to time. These codes extend trial access and do not constitute a cash credit or refund. Codes may not be combined and are subject to the terms under which they were issued. GlucoTV reserves the right to revoke codes or credits obtained through abuse or misuse of the referral system.

9. Shareable View Links

GlucoTV provides shareable view links that allow third parties to view glucose readings without an account. By generating and sharing a view link, you acknowledge that anyone with that link can access the glucose display associated with it.

You are responsible for managing who you share view links with. GlucoTV is not responsible for unauthorized access resulting from a shared link being forwarded to unintended parties.

View links are secured by a unique identifier (UUID) and do not expose your account credentials or personal information to viewers.

10. Acceptable Use

You agree not to use GlucoTV in any way that:

  • Violates any applicable law or regulation
  • Infringes the rights of any third party
  • Attempts to gain unauthorized access to our systems or another user's account
  • Attempts to reverse engineer, decompile, or extract source code from the Service
  • Uses automated tools to scrape, crawl, or bulk-fetch data from the Service
  • Misrepresents your identity or affiliation when using the Service
  • Creates multiple accounts to circumvent the one-trial-per-email policy

We reserve the right to suspend or terminate accounts that violate these Terms without notice or refund.

11. Service Availability

GlucoTV is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be available at all times, error-free, or uninterrupted. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Glucose data availability also depends on third-party services including Dexcom and Nightscout. We are not responsible for delays, gaps, or inaccuracies in glucose data caused by those services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, GlucoTV and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or any harm resulting from reliance on glucose information displayed by the Service.

In no event shall our total liability to you for any claim arising from or related to the Service exceed the amount you paid to GlucoTV in the three months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

13. Disclaimer of Warranties

GlucoTV is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that glucose readings displayed by the Service will be accurate, timely, or complete. CGM data is inherently subject to sensor lag, connectivity issues, and other limitations that are outside our control.

14. Indemnification

You agree to indemnify, defend, and hold harmless GlucoTV and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Third-Party Services

GlucoTV integrates with third-party services including Dexcom, Nightscout, Stripe, Firebase, and Google Cloud. Your use of those services is subject to their respective terms of service and privacy policies. GlucoTV is not responsible for the practices or content of any third-party service.

16. Intellectual Property

The GlucoTV name, logo, and all content and software comprising the Service are the property of GlucoTV and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

17. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, abuse of the referral system, or fraudulent activity.

You may terminate your account at any time by using the account deletion feature in your account settings. Upon termination, your right to use the Service ceases immediately.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts.

19. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify subscribers of significant changes. Your continued use of the Service after such changes constitutes acceptance.
